Terms of Service

These Terms of Service (“Terms”) govern your access to and use of codersduostudio.com (the “Site”), operated by Coders Duo Studio (“we”, “us”, “our”). By accessing or using the Site, you agree to these Terms. If you do not agree, do not use the Site.

These Terms are governed by EU law, including:

  • Directive 2011/83/EU on consumer rights
  • Directive 93/13/EEC on unfair contract terms
  • The Digital Services Act (Regulation (EU) 2022/2065, “DSA”)

1. Eligibility – 18+ only

The Site contains content intended for audiences aged 18 and over, including mature themes, strong language, and adult fiction. By using the Site, you represent that:

  • You are at least 18 years of age, or the age of majority where you live, whichever is greater
  • It is lawful for you to access content of this nature where you live
  • You have the legal capacity to enter into these Terms

We use a self-declaration age gate. Falsely confirming your age may breach these Terms and may, in some jurisdictions, be a criminal offence.

2. Pre-launch status

The Site is currently a pre-launch presence for Heroic Rescue Academy. Any features, products, or experiences described on the Site may not yet be available, may change, and are not guaranteed to launch in any particular form or timeframe.

Subscribing to our newsletter does not create a contract for the supply of goods or digital content. It is a free service that you may withdraw from at any time.

4. Intellectual property

All content on the Site – text, graphics, logos, images, animations, video, audio, code, and the Heroic Rescue Academy name and brand – is owned by Coders Duo Studio or its licensors and is protected under copyright law, the EU Copyright in the Digital Single Market Directive ((EU) 2019/790), and international intellectual property treaties.

You may not, without our prior written permission:

  • Reproduce, distribute, modify, adapt, publicly communicate, or create derivative works of Site content
  • Use any of our trademarks, trade names, or branding
  • Reverse-engineer or decompile any software, except where permitted by Article 6 of Directive 2009/24/EC (interoperability)
  • Use automated scrapers, bots, or text-and-data-mining tools, except as permitted by Article 4 of Directive (EU) 2019/790 (general TDM exception), where we have not expressly reserved our rights, or Article 3 (scientific research TDM). We expressly reserve our rights under Article 4(3) for any commercial text and data mining of Site content, including for the purposes of training generative AI models.

You may share links to the Site and quote short excerpts for the purposes of news reporting, criticism, or review (consistent with Article 5(3)(d) of Directive 2001/29/EC Copyright Act), provided you attribute the source.

5. User conduct

You agree not to use the Site to:

  • Violate any applicable law or regulation
  • Infringe on the intellectual property, privacy, or other rights of others
  • Transmit malware or any code intended to damage or interfere with computer systems
  • Attempt to gain unauthorised access to the Site, our servers, or connected systems
  • Interfere with the proper operation of the Site, including denial-of-service attacks
  • Submit false, misleading, or fraudulent information
  • Bypass or attempt to circumvent the age verification mechanism
  • Harass, threaten, defame, or impersonate any person

6. Newsletter

By subscribing to our newsletter, you consent to receive periodic emails from us. You can unsubscribe at any time, free of charge, by clicking the unsubscribe link in any email or by contacting legal@codersduostudio.com. See our Privacy Policy.

The newsletter is a free service. The right of withdrawal under §56 of the Law of Obligations Act and Directive 2011/83/EU does not apply to free services, but you can stop receiving emails at any time.

7. Disclaimers

The Site is provided “as is” and “as available”, to the fullest extent permitted by law. We do not warrant that the Site will be uninterrupted, error-free, secure, or free of harmful components.

Nothing in these Terms excludes or limits:

  • Liability for death or personal injury caused by negligence
  • Liability for fraud or fraudulent misrepresentation
  • Mandatory consumer rights under Estonian and EU law that cannot be waived by contract
  • Any other liability that cannot be excluded under applicable law

8. Liability

For consumers in EU member states, mandatory consumer protection rules of the country where you habitually reside apply and take precedence over any contradictory provisions of these Terms.

Subject to Section 7 and the paragraphs above, our total aggregate liability for direct loss arising out of or in connection with the Site or these Terms is limited to €100 (one hundred euros). We are not liable for indirect, consequential, or special damages, including loss of profits, data, goodwill, or anticipated savings, except where such limitation is not permitted under your national law.

9. Online dispute resolution

9.1 EU consumers

If you are a consumer resident in the European Union, you may use the European Commission’s Online Dispute Resolution (ODR) platform to resolve disputes out of court:

We are not currently obliged or willing to participate in dispute resolution proceedings before any other consumer arbitration body, but we will engage with the Consumer Disputes Committee and the ODR platform in good faith.

10. Suspension and termination

We may suspend or terminate your access to the Site if we reasonably believe you have breached these Terms or are using the Site to harm others. Where lawful and practicable, we will give you prior notice with reasons.

If we permanently terminate access, you may lodge a complaint via legal@codersduostudio.com, and, if you reside in the EU, you may use the ODR platform.

11. Changes to these Terms

We may update these Terms. The “Last updated” date at the top reflects the most recent revision. We will give reasonable advance notice of material changes via the Site banner.

We will not apply changes retroactively to your detriment. Continued use of the Site after the effective date constitutes acceptance, but you retain the right to stop using the Site instead.

12. Governing law and jurisdiction

These Terms are governed by the laws of the EU, without regard to its conflict of laws principles.

Important consumer protections:

  • If you are a consumer habitually resident in an EU member state, you retain the protection of mandatory provisions of the law of your country of residence (Article 6 of Regulation (EC) No 593/2008, “Rome I”).
  • If you are a consumer, you can bring legal proceedings against us in the courts of your country of residence, and we may bring proceedings against you only in the courts of your country of residence (Articles 17–19 of Regulation (EU) No 1215/2012, “Brussels I recast”).

13. Severability

If any provision of these Terms is unenforceable, the remaining provisions continue in full force. The unenforceable provision shall be replaced with an enforceable one that most closely reflects the original intent – or, where consumer-protective rules are concerned, the interpretation more favourable to the consumer applies.

14. Entire agreement

These Terms, with our Privacy Policy and Cookie Policy, constitute the entire agreement between you and us regarding the Site.

15. Site visitors outside the EU/EEA

These Terms apply to all visitors regardless of location. Where your local law grants you additional consumer protections beyond EU law, those local protections apply to you to the extent they are mandatory under your national law.

If you are visiting from a jurisdiction where consumer law materially differs (e.g., the United States, Canada, Australia), please review our Privacy Policy Section 11 for additional rights you may have.
